South Korean courts are producing different interim rulings in disputes over employersโ bargaining duties under the revised Trade Union Act, often called the Yellow Envelope Act. The Seoul Administrative Court granted POSCO requests to suspend labor commission decisions, citing the risk of harm before questions about employer status and bargaining obligations are resolved.
The main cases will determine how far those duties extend and whether companies must bargain before the underlying legal questions are settled.
